Relevant experience

  • P&I cover dispute (2022-2026): Arbitration concerning the scope of P&I cover following cargo damage sustained during encounter of adverse weather. The dispute centred on the interpretation of contractual exclusion clauses relating to unsafe cargo stowage and securing, including the distinction between mandatory rules and non-binding recommendations under the CSS Code.
  • Heroic Idun (2022–2025): Represented The Norwegian Shipowners’ Mutual War Risks Insurance Association (DNK) in a major arbitration. The tribunal denied the shipowner’s claim for total loss and sue and labour after a nine-month detention in West Africa, as law enforcement and perceived piracy are not war perils under the Nordic Marine Insurance Plan.
  • Total loss and related cases Ukraine (2020–present): Assisting insurers with several total loss cases arising as a result of the Russian invasion of Ukraine, including related P&I matters.
  • H&M claim adjustment – tank coating (2021–2024): Represented H&M insurers regarding cover for a large fleet of chemical tankers after tank coating failures led to extensive corrosion and repairs. Key issues included the exclusion for design errors, causation, and insurers’ rights to recover the proceeds the insured obtained in a London arbitration against the coating manufacturer.
  • P&I cover dispute (2022–2024): Arbitration concerning P&I cover after a container shifting incident allegedly due to breach of safety regulations (the ISM Code).
  • Collision ferry and motor yacht (2020–2024): Assisted insurers with the insurance settlement following a collision between a ferry and a motor yacht in Norway.
  • Cheshire (2017–2021): Represented shipowners and insurers in litigation against cargo interests over liability for the total loss of both the vessel and the cargo following decomposition of fertilisers carried on board the vessel.
  • Mineral Libin (2016–2020): Dispute arising from a casualty led to litigation up to the Norwegian Supreme Court on time‑bar issues in direct action claims against liability insurers. The Supreme Court decision provides a number of welcome clarifications in terms of applicable time bar rules for direct action claims.

Maritime and energy operations are conducted within an increasingly complex framework of regulation, heightened safety requirements and rapid technological development. Insurance issues arise throughout the lifecycle of projects and operations, from contractual structuring and placement of cover to casualty response and disputes.

Decisions frequently need to be taken at short notice, on the basis of incomplete information, and in close coordination with technical, commercial and operational considerations. The risk profile continues to evolve, with insurance considerations increasingly extending to security-related incidents, sanctions exposure and cyber risks. These developments raise complex questions of cover, liability and compliance.
