Consumer Markets

Globalization and new technology have changed our consumer habits. In the EU, there has been a strong focus in recent years on adapting legislation to the modern market and strengthening consumer protection. This has resulted in new and stricter requirements for businesses offering goods and services to Norwegian consumers – including increased risk.

Thommessen has a dedicated team with expertise in consumer and market legislation. This allows us to assist national and international clients in keeping track of the rapidly changing and increasingly extensive regulation. We also have in-depth industry knowledge that enables us to assist in implementing measures and processes to ensure compliance with consumer and market legislation, as well as the commercial agreements between the various participants in the retail value chain.

We handle all types of legal issues relevant to businesses offering goods and services to Norwegian consumers and assist with:

  • Advising on all aspects of advertising and marketing, such as assessing advertising campaigns, sending out marketing inquiries, and influencer marketing
  • Assistance to e-commerce businesses, for example about the right of withdrawal and requirements for the purchase and order process
  • Guidance on sales marketing rules, including the requirement for a previous price
  • Collection and processing of personal data
  • Negotiation, conclusion, and follow-up of supplier agreements, dealer agreements, and franchise agreements
  • Advising on various forms of payment and repayment solutions
  • Creation and review of purchase terms and privacy statements
  • Guidance on obligations under the Consumer Purchase Act, Digital Services Act, Product Liability Act, and related legislation
  • Advising on legislation related to lottery and gambling
  • Guidance on the use of environmental and climate claims in marketing
  • Handling cases for the courts, the Consumer Authority, the Consumer Complaints Board, the Market Council, and the Food Industry's Professional Committee
  • Regulatory issues, such as product labelling, waste management, and environmental requirements, and assistance with product recalls
